Question:

How many children can I legally care for in New York State (NYS)?

Answer:

In NYS, you can care for no more than 2 non-related children for more than 3 hours per day without obtaining a registration or license.  If you would like to care for more than 2 non-related children for more than 3 hours a day, you must first be licensed or registered.  To find out more about obtaining a registration or a license, please contact our office.

A registered Family Child Care Provider can care for up to 6 children not enrolled in Kindergarten or above (no more than 2 under the age of 2 years) and 2 school-age children (enrolled in Kindergarten above) if approved. 

A licensed Group Family Child Care Provider can care for up to 14 children not enrolled in Kindergarten or above (no more than 2 under the age of 2 years for each caregiver) and 4 school-age children (enrolled in Kindergarten above) if approved. 

School-age Child Care programs and Child Care Centers are given a maximum number of children they can care for based on their available space.
